Welcome to SolidarityMail! Before you may register an account and use the service, you must read and agree to these Terms of Use.
This is a contract ("Agreement") between you and SolidarityMail ("We," "Us," or the "Service"). SolidarityMail is a free email service, and may be changed from time to time and is provided "AS-IS" and "AS AVAILABLE". You must be at least eighteen (18) years of age to use the Service, and you must provided current, accurate identification, contact and other information that may be required as part of the registration process and/or continued use of the Service. You understand and agree that SolidarityMail assumes no responsibility or liability for, among other things, the availability, timeliness, security, or reliability of the Service. Additionally, SolidarityMail takes no responsibility for any third party content, including any viruses or other disabling features, or any other dealings with third parties. Nothing in this Agreement shall be deemed to confer any third party rights or benefits. We make no guarantees or warranties at all. If you do not accept and abide by this Agreement, you may not use the SolidarityMail Service. This Agreement supersedes and cancels all previous and contemporaneous agreements, commitments and writings with respect to this subject matter. You agree that if any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. SolidarityMail reserves the right to refuse the Service to anyone at any time, without notice and for any reason.
1. Use and Responsibility for the Service. The Service is provided for your personal use only, and you may not use the Service for any commercial purposes or in any way that is illegal. You agree to avoid excessive use of the Service, and you may not use any software or hardware that reduces the number of users directly accessing or using the Service. You are responsible for all activity under your SolidarityMail account, and are responsible for maintaining the confidentiality or the password for your SolidarityMail account. You must notify us immediately about any unauthorized use of your account or any security breach relating to your account.
You may not use the Service to:
- Harass other people,
- Harm or exploit minors,
- Impersonate or cause others to believe that you are another person,
- Collect personal data from SolidarityMail users without their express consent,
- Interfere or disrupt the Service, those of our users, or any other person or service, or
- Send unsolicited emails, described in the section below.
2. Unsolicited Email ("SPAM"). You will not use the Service to transmit, either directly or indirectly, or facility transmission of any unsolicited bulk email or unsolicited commercial email. Emails to other SolidarityMail accounts sent via the SolidarityMail mass mailing feature does not count as such, considering that the content of the email is directly related to one of the pre-defined issues chosen for the email. SolidarityMail shall, in its sole discretion, have the right to determine what it believes to be a misuse of this feature and any such determined misuse shall result in termination.
3. Your Intellectual Property Rights. SolidarityMail does not claim ownership of content you upload, transmit, or store in your SolidarityMail Account.
4. Privacy. SolidarityMail respects your privacy. We will not give out your personal information, including information that you upload, transmit, or otherwise store in your SolidarityMail account, to anyone, except as required by law.
5. Modification of Agreement. SolidarityMail may, in its sole discretion, modify or revise this Agreement at any time, and you agree to be bound by any such modifications or revisions. Modified Agreements will be posted at our site at www.solidaritymail.com/tou.php, and we may attempt to notify you via your SolidarityMail account about any major changes to this Agreement.
6. Termination. SolidarityMail may, in its sole discretion, whether you violate this agreement or not, terminate the Service, terminate this Agreement, or terminate your account, at any time and for any reason. Your account may also be terminated after a six (6) month period of inactivity, and the email address associated with your account may be given to another use without notice to you. You may cancel your use of the Service at any time, with or without cause, by providing notice to us. Upon termination, your right to access the Service ceases immediately.
7. Assignment. We may assign this contract, in whole or in part, at any time, without or without cause. You may not assign this contract, or any part of it, to any other party.
8. No Warranty. We provide the Service "AS-IS," "WITH ALL FAULTS" and "AS AVAILABLE." SolidarityMail gives no express warranties, guarantees or conditions. To the extent permitted by law, we exclude the implied warranties of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement. Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.
9. Liability Limitation. You expressly understand and agree that SolidarityMail shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; (iii) unauthorized access to or alteration of your transmissions or data; or (iv) any other matter relating to the Service. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
10. Indemnification. You agree to hold harmless and indemnify SolidarityMail, and its subsidiaries, affiliates, directors, officers, agents, volunteers, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.
